Home office publishes new guidance on right to rent checks
The Home Office has published new guidance on how to deliver Right to Rent checks following the end of the grace period created by the EU Withdrawal Agreement.
From 1 July 2021, the majority of EEA citizens will prove their Right to Rent using the Home Office online checking service. Those who have made a successful application to the EU Settlement Scheme will have been provided with digital evidence of their immigration status.
Individuals will be able to provide a share code and their date of birth which will enable you to check their Home Office immigration status via a real time online service.
Agents will create a statutory excuse against liability for a civil penalty by carrying out
the check using the Home Office online service. Where an EEA citizen has been granted ‘Settled Status’ by the Home Office, they will have a continuous Right to Rent, in the same way as someone with Indefinite Leave to Remain.
Where an EEA citizen has been granted ‘Pre-Settled Status’ by the Home Office, they will have a time-limited Right to Rent, requiring a follow-up check. The Home Office online service will advise when a follow-up check must be carried out.
